Whether you are dealing with minor car accidents or more severe collisions, it’s crucial to understand the steps involved and the role of a car accident lawyer in guiding you through each phase. This section will cover the essential elements of filing a car accident claim and how an experienced car accident attorney can help you navigate the legal landscape.

Initial Steps in Filing a Claim

After ensuring your safety and seeking medical attention, the first step in filing a car accident claim is to report the accident to your insurance company. It’s important to provide accurate and detailed information about the accident, including the date, time, location, and circumstances surrounding the incident. This initial report will set the foundation for your claim.

1. Gathering Evidence: Evidence is crucial in supporting your car accident claim. Collecting documentation such as medical records, police reports, and witness statements is essential. Photographs of the accident scene, vehicle damage, and injuries can also serve as powerful evidence.

2. Medical Records and Treatment: Medical records play a vital role in car accident cases. They document the extent of your injuries and the treatment required, which are critical in calculating the compensation you deserve. Ensure you follow all medical advice and keep records of all treatments and expenses.

3. Police Report: A police report provides an official account of the accident. It includes details about the accident scene, the parties involved, and any citations issued. This report is a crucial piece of evidence that your car accident attorney will use to build your case.

Dealing with Insurance Companies

Dealing with insurance companies can be one of the most challenging aspects of filing a car accident claim. Insurance companies often aim to minimize payouts, and their adjusters are trained to protect their company’s interests. This is where the expertise of a car accident lawyer becomes invaluable.

1. Negotiating with Insurance Companies: Your car accident lawyer will handle all communications with the insurance companies. They will negotiate on your behalf to ensure that you receive a fair settlement that covers your medical bills, lost wages, property damage, and other expenses.

2. Dealing with Denied Claims: If your claim is denied, your car accident injury lawyer will investigate the reasons for the denial and work to appeal the decision. They will gather additional evidence, if necessary, and present a compelling case to support your claim.

3. Ensuring Fair Compensation: Insurance companies may offer a quick settlement that is far less than what you deserve. An experienced car accident attorney will ensure that you do not settle for less and will fight for the maximum compensation you are entitled to.

Common Challenges in Car Accident Cases

Car accident cases can present various challenges, from proving fault to dealing with complex legal procedures. Here are some common challenges and how a car accident attorney can help you overcome them:

Strategies for Maximizing Your Car Accident Settlement

Understanding the Settlement Process

Securing a fair settlement in a car accident case requires a combination of thorough preparation, strategic negotiation, and a deep understanding of the legal landscape. Car accident attorneys utilize various strategies to maximize the compensation their clients receive. In this section, we’ll explore these strategies and how they can significantly impact the outcome of your car accident claim.

Thorough Case Preparation

One of the most critical steps in achieving a favorable settlement is thorough case preparation. A well-prepared case provides a solid foundation for negotiations and can make a significant difference in the final settlement amount.

1. Comprehensive Evidence Collection: Collecting comprehensive evidence is essential. This includes obtaining all relevant medical records, police reports, and witness statements. Photographs of the accident scene, vehicle damage, and your injuries also serve as powerful evidence.

2. Medical Expert Testimony: In some cases, medical expert testimony may be required to substantiate the extent of your injuries and the impact on your life. Your car accident attorney will work with medical professionals to provide expert testimony that supports your claim.

3. Detailed Documentation: Keeping detailed documentation of all expenses related to the car accident, including medical bills, lost wages, and any other costs, is crucial. This documentation helps in accurately calculating the total damages you are entitled to.

Strategic Negotiation with Insurance Companies

Negotiating with insurance companies is a critical aspect of securing a fair settlement. Car accident attorneys are skilled negotiators who understand the tactics used by insurance adjusters to minimize payouts.

1. Understanding Insurance Company Tactics: Insurance companies often employ tactics to reduce the settlement amount. This can include disputing liability, downplaying the severity of your injuries, or offering a quick but inadequate settlement. An experienced car accident lawyer can counter these tactics effectively.

2. Strong Negotiation Skills: The best car accident attorney will negotiate aggressively on your behalf to ensure that the settlement offer reflects the true extent of your damages. They will present a compelling case supported by evidence and expert testimony to convince the insurance company to pay a fair amount.

3. Preparedness for Litigation: Insurance companies are more likely to offer a fair settlement if they know that your attorney is prepared to take the case to court if necessary. Being ready to litigate demonstrates that you are serious about securing the compensation you deserve.

Calculating the Full Extent of Damages

Accurately calculating the full extent of your damages is essential for maximizing your settlement. This involves considering both economic and non-economic damages.

1. Economic Damages: Economic damages include tangible costs such as medical bills, lost wages, and property damage. Your car accident attorney will ensure that all current and future expenses are accounted for in the settlement demand.

2. Non-Economic Damages: Non-economic damages, such as pain and suffering, emotional distress, and loss of enjoyment of life, are more subjective but equally important. An experienced car accident lawyer will work to quantify these damages and include them in the settlement demand.

3. Future Expenses: In cases involving serious injuries, future medical bills and ongoing treatment costs must be considered. Your attorney will work with medical experts to estimate these future expenses and include them in the settlement calculation.

Utilizing a Free Consultation

Taking advantage of a free consultation with a car accident attorney can provide valuable insights into your case and the strategies that will be used to maximize your settlement.

1. Case Evaluation: During the free consultation, the attorney will evaluate the specifics of your case, including the circumstances of the accident, the severity of your injuries, and the potential damages you may be entitled to.

2. Legal Strategy Discussion: The attorney will discuss the legal strategy they plan to use to secure the maximum compensation. This includes the approach to evidence collection, negotiation tactics, and the potential for litigation.

3. Understanding Your Rights: The consultation is an opportunity for you to understand your legal rights and the options available to you. The attorney will explain the legal process and answer any questions you may have.

Maximizing your car accident settlement requires a strategic approach, thorough preparation, and skilled negotiation. Types of Damages in Car Accident Cases

Understanding Recoverable Damages

In the aftermath of a car accident, understanding the types of damages you can recover is crucial for obtaining fair compensation. Car accident attorneys are skilled in identifying and calculating these damages to ensure that you receive the maximum settlement possible. This section will explore the various types of damages you can claim and how an experienced car accident lawyer can help you recover them.

Economic Damages

Economic damages are quantifiable costs that result from a car accident. These damages are relatively straightforward to calculate and include the following:

1. Medical Bills: Medical expenses are often the most significant component of economic damages. This includes emergency room visits, hospital stays, surgeries, physical therapy, prescription medications, and any other medical treatments related to your car accident injuries. Your car accident attorney will ensure that all past, current, and future medical bills are included in your claim.

2. Lost Wages: If your injuries prevent you from working, you can claim compensation for lost wages. This covers the income you have already lost due to the accident and any future earnings you will miss out on as a result of your injuries. Accurate documentation of your earnings and employment status is essential for this claim.

3. Property Damage: The cost of repairing or replacing your vehicle and any other personal property damaged in the accident is also recoverable. This includes rental car expenses while your vehicle is being repaired.

4. Other Out-of-Pocket Expenses: Any additional expenses directly related to the accident, such as transportation to medical appointments or modifications to your home to accommodate your injuries, can also be claimed.

Non-Economic Damages

Non-economic damages are more subjective and compensate for the intangible losses you suffer due to the accident. These damages are often more challenging to calculate but are equally important in ensuring you receive fair compensation.

1. Pain and Suffering: Pain and suffering encompass the physical pain and emotional distress you experience as a result of the car accident. This can include chronic pain, anxiety, depression, and loss of enjoyment of life. Your car accident attorney will work to quantify these damages and present a compelling case for compensation.

2. Emotional Distress: Emotional distress covers the psychological impact of the accident, such as trauma, anxiety, and depression. Expert testimony from mental health professionals may be used to support this claim.

3. Loss of Consortium: In cases where the accident impacts your relationship with your spouse, you may claim loss of consortium. This covers the loss of companionship, affection, and intimacy.

4. Loss of Enjoyment of Life: If your injuries prevent you from enjoying activities you once loved, you can claim compensation for loss of enjoyment of life. This includes hobbies, sports, and other recreational activities that you can no longer participate in due to your injuries.

Punitive Damages

In some cases, you may be eligible for punitive damages. These damages are not intended to compensate you for your losses but to punish the negligent driver and deter similar behavior in the future. Punitive damages are typically awarded in cases involving gross negligence or intentional misconduct, such as drunk driving.

Building a Strong Case for Damages

To recover these damages, your car accident attorney will build a strong case that clearly demonstrates the extent of your injuries and the impact on your life. This involves:

1. Gathering Evidence: Comprehensive evidence collection is crucial. This includes medical records, police reports, witness statements, and expert testimony.

2. Detailed Documentation: Keeping detailed records of all expenses and the impact of your injuries on your daily life will support your claim for both economic and non-economic damages.

3. Expert Testimony: Medical experts, mental health professionals, and other specialists can provide testimony that substantiates the severity of your injuries and their impact.

4. Legal Expertise: An experienced car accident lawyer understands the legal standards for proving damages and will craft a compelling argument to maximize your compensation.

Recovering the full extent of damages in a car accident case requires a thorough understanding of both economic and non-economic losses. By working with a skilled car accident attorney, you can ensure that all aspects of your damages are accurately calculated and effectively presented. In the next section, we will discuss the importance of timely action in car accident cases and the statute of limitations for filing a claim.

Frequently Asked Questions About Car Accidents

How Much Can Someone Sue for a Car Accident in NC?

The amount someone can sue for a car accident in North Carolina depends on various factors, including the severity of injuries, the extent of property damage, and the specific circumstances of the case. Compensation may cover medical expenses, lost wages, pain and suffering, and property damage. There is no set limit, but North Carolina follows the doctrine of contributory negligence, meaning that if you are found to be even slightly at fault, you may be barred from recovering any damages.

Is NC a No-Fault State?

No, North Carolina is not a no-fault state. It follows an at-fault system, meaning that the driver who is determined to be at fault for the accident is responsible for covering the damages. This can be done through their insurance policy. Because of this, determining fault is crucial in North Carolina car accident cases, and having a car accident attorney can help ensure that liability is accurately assessed.

What Are the Accident Laws in North Carolina?

North Carolina’s accident laws include several key aspects:

  • Reporting: Accidents that result in injury, death, or significant property damage must be reported to the police.
  • Contributory Negligence: If a victim is found to be even 1% at fault, they cannot recover any damages from the other party.
  • Statute of Limitations: There is a three-year limit to file a personal injury lawsuit and a two-year limit for wrongful death claims.

What Happens If the Person at Fault in an Accident Has No Insurance in NC?

If the at-fault driver has no insurance, you can turn to your own insurance policy if you have uninsured motorist coverage. This coverage will help pay for your medical expenses, lost wages, and other damages. Additionally, you may have underinsured motorist coverage to cover the difference if the at-fault driver’s insurance is insufficient.

How Much Are Most Car Accident Settlements?

The amount of car accident settlements varies widely based on factors such as the severity of injuries, the extent of property damage, and the impact on the victim’s life. Settlements can range from a few thousand dollars for minor accidents to hundreds of thousands or even millions for severe injuries. An experienced car accident attorney can help evaluate the specifics of your case and negotiate a fair settlement.

How Long After an Accident Can You Sue in NC?

In North Carolina, the statute of limitations for filing a personal injury lawsuit after a car accident is three years from the date of the accident. For wrongful death claims, the statute of limitations is two years from the date of death. It is crucial to act within these time frames to preserve your right to seek compensation.

Who Determines the Fault in an Accident in NC?

Fault in a car accident in North Carolina is determined based on evidence such as police reports, witness statements, traffic laws, and accident reconstruction analysis. Insurance companies often conduct their investigations to assess fault, but their determinations can be contested. A car accident lawyer can help gather and present evidence to establish liability accurately.

Who’s at Fault in a Rear-End Collision in North Carolina?

In most cases, the driver who rear-ends another vehicle is considered at fault for the collision. However, there can be exceptions if the front driver suddenly stopped without reason or if there were other mitigating circumstances. Establishing fault requires careful examination of the facts and may benefit from the expertise of a car accident attorney.

What is the Negligence Law for North Carolina?

North Carolina follows the contributory negligence rule. This strict law means that if a plaintiff is found to be even 1% at fault for the accident, they cannot recover any damages from the other party. This rule makes it essential to have a strong legal representation to argue against any allegations of contributory negligence and to establish the other party’s fault clearly.

  • Symptoms include intense pain, swelling, bruising, and inability to move the affected body part.
  • Treatment can range from casting and splinting to surgery for severe breaks.

Remember, folks, it’s not just speed that kills; even slow-paced crashes can result in broken bones.

  • Symptoms may include headaches, nausea, confusion, and loss of coordination.
  • Treatment can involve rest, medication, rehabilitation, or in severe cases, surgery.

Always, and we mean ALWAYS, seek medical attention after an accident, even if you’re feeling fine. TBIs can be sneaky devils, with symptoms sometimes appearing days or even weeks after the initial injury.

Spinal Cord Injuries: A Tangled Web

Few things can send a chill down your spine quite like the phrase ‘spinal cord injury.‘ These injuries can result in partial or complete paralysis, transforming a person’s life in the blink of an eye.

  • Symptoms depend on the injury’s severity and can include loss of movement, sensation, or control over bodily functions.

Passenger In Car Accident: Your Legal Rights in Charlotte, North Carolina, and South Carolina

Passenger In Car Accident? Understanding Your Legal Rights as a Passenger.

Car accidents are a stressful and traumatic experience, especially for passengers who may feel helpless and unsure of their rights. If you were a passenger in a car accident in Charlotte, North Carolina, or South Carolina, you have legal rights that protect you from financial loss and physical harm. In this article, we will explore these legal rights and provide you with useful information on how to seek medical attention, document the accident scene, and file a personal injury claim as a passenger.

Why You Need a Personal Injury Attorney

If you were a passenger in a car accident, you may be entitled to compensation for your injuries, medical expenses, lost wages, and pain and suffering. However, insurance companies may try to offer you a low settlement or deny your claim altogether. That’s why it’s important to hire an experienced personal injury attorney who can protect your rights and negotiate with insurance companies on your behalf. A skilled attorney can help you with the following:

  • Reviewing your case and explaining your legal rights and options
  • Gathering evidence, such as medical records and witness statements
  • Negotiating with insurance companies for a fair settlement
  • Representing you in court if necessary

Seeking Medical Attention After a Car Accident

The first and most important step after a car accident is to seek medical attention, even if you feel fine. Some injuries, such as whiplash or traumatic brain injury, may not show symptoms immediately and can worsen over time. Moreover, a medical report can be a crucial piece of evidence in your personal injury claim. Here’s what you should do:

  • Call 911 if someone is seriously injured or if the accident caused significant property damage
  • Seek medical attention as soon as possible, even if you feel fine
  • Follow your doctor’s orders and attend all follow-up appointments
  • Keep all medical records and bills related to the accident

Documenting the Accident Scene

If you are physically able to do so, it’s important to gather as much evidence as possible at the accident scene. This evidence can help establish liability and prove the extent of your injuries. Here are some tips on how to document the accident scene:

  • Take photos of the damage to all vehicles involved, including the license plates
  • Take photos of any visible injuries you or other passengers sustained
  • Write down the names and contact information of all drivers, passengers, and witnesses
  • Obtain a copy of the police report and make note of the officer’s name and badge number
  • Do not admit fault or sign any documents without consulting with an attorney

Filing a Personal Injury Claim as a Passenger

As a passenger in a car accident, you may file a personal injury claim against the driver(s) responsible for the accident. The following steps can help you file a successful claim:

  • Contact an experienced personal injury attorney as soon as possible
  • Provide your attorney with all relevant information and documentation, including medical records and bills
  • Your attorney will investigate the accident, gather evidence, and negotiate with insurance companies for a fair settlement
  • If a settlement cannot be reached, your attorney may file a lawsuit and represent you in court

What to Do After a Car Accident: A Guide from a Charlotte NC Car Accident Lawyer

A Guide from a Charlotte NC Car Accident Lawyer : What to Do After a Car Accident

Car accidents can be a traumatic experience, leaving drivers and passengers shaken and unsure of what to do next. As a car accident lawyer in Charlotte NC, I have seen firsthand the importance of taking the right steps after a car accident. In this guide, I will share the 10 most important things you should do after a car accident to protect yourself and your legal rights.

Check for injuries:

The first priority after a car accident is to check for injuries. If anyone is injured, call 911 immediately. Even if no one appears to be hurt, it’s a good idea to see a doctor as soon as possible, as some injuries may not be immediately apparent.

Move to a safe location:

If possible, move your vehicle to a safe location off the road. This can help prevent further accidents and ensure that emergency responders have clear access to the scene.

Call the police:

Even if the accident is minor, it’s important to call the police and file a report. This can be critical for insurance purposes and may also be required by law.

Exchange information:

Exchange contact and insurance information with the other driver(s) involved in the accident. Be sure to get their name, phone number, email address, driver’s license number, license plate number, and insurance information.

Document the scene:

Take photos of the accident scene, including damage to all vehicles involved, any injuries, and any skid marks or other evidence of the accident. This documentation can be helpful in determining fault and may also be useful in court.

Don’t admit fault:

It’s important not to admit fault or apologize for the accident, even if you think you may have been at fault. This can be used against you in court or by insurance companies.

Contact your insurance company:

Contact your insurance company as soon as possible to report the accident and provide them with the information you gathered at the scene. Be honest and provide all relevant details, but do not admit fault.

Don’t talk to the other driver’s insurance company:

While you may be required to speak with your own insurance company, you are not required to speak with the other driver’s insurance company. In fact, it’s generally best to avoid doing so without first consulting with a car accident lawyer.

Consult with a car accident lawyer:

If you’ve been injured or if there is significant property damage, it’s a good idea to consult with a car accident lawyer. A lawyer can help protect your legal rights, ensure that you receive fair compensation, and negotiate with insurance companies on your behalf.

Keep records:

Keep detailed records of all medical treatment, expenses, and other costs associated with the accident. This can be helpful in determining the full extent of your damages and may be useful in court.

How do serious injuries occur?

Millions of people in the United States are injured every year from preventable accidents. These accidents can take place in many different ways but most often, it is caused by negligence or recklessness.

According to the National Security Council, in 2018, 46.5 millions Americans were injured and 167,127 were killed in preventable incidents.

Due to the significant expenses associated with serious injury, these incidents caused a loss of approximately $1,059.9 billion in national finances.

It is a scary reality that preventable accidents happen even in North Carolina. This resulted in 6,007 deaths in 2018.

The shocking statistics revealed that the most preventable deaths in the United States were caused by these five horrendous causes.

  • Poisoning
  • Motor vehicle accidents
  • Falls
  • Suffocation
  • Drowning

It is possible to prevent these terrible events by acting safely and trying to protect others. Negligent behavior can cause danger to others, but many people don’t understand this.

The person responsible for your accident should have been able to protect you and your loved ones. They now must face the consequences.

Why should I hire a personal injury lawyer in Charlotte NC?

Personal injury law is applicable to a wide range of accidents and injuries that can occur due largely to negligence by another. Almost all accidents involve regulations and deadlines which can make filing an injury difficult.

When an injury occurs your body cannot learn the law and navigate the court system. A mistake in an accident may further hinder your ability to obtain justice for your case.

You have to get in touch with a lawyer if your situation requires more help to ease the burden on yourself.

North Carolina and South Carolina Personal Injury Laws

Many North Carolina or Southern Carolina laws govern the way personal injuries are settled and paid for. While different laws regulate types of accidents, the two main laws that cover almost every accident injury claim are the statute of limitation regulations and the contributory negligence.

The state has imposed limits for personal injury litigation. In most cases, victims only need three years of injury to seek compensation.

Common injuries suffered in personal injury accidents

Personal injury accidents are general legal terms covering various accidents. Personal Injury can have very different outcomes and make every accident different. Some injuries can keep a person from being active, and can affect them for several days. The most significant accident can result in death. Most injuries from accidents usually include the following:

– Broken bones. This can be caused by a hard impact, such as hitting the ground after falling off of a ladder or slipping on ice and landing hard on your elbows or knees. Fractures are extremely common in personal injury accidents and they often require surgery to repair them.

– Head injuries. Concussions are quite common after experiencing a hard impact to the head, such as a car accident or an assault. Concussions can have long-term effects on your brain and require medical treatment.

– Whiplash. This injury is caused by violent back-and-forth motion of the head and neck, which often occurs after a car accident or other high-impact event. Whiplash can be extremely painful and may require physical therapy to heal.

Many hospitalized or surgery-related injuries require several doctors visits and sometimes physiotherapy and rehabilitation services.

What is the Compensation for an Injury?

In the event of a serious accident you could sustain severe injuries that can impact your life for many years. This goes equally for work comp injuries such as traumatic brain injuries.

The injury can require ongoing medical treatment and a lengthy recovery, which could result in significant costs for you and your loved one.

Because of someone else’s negligence, you shouldn’t have to shoulder this financial burden.

If you file a personal injuries claim, you can get compensation for the damage this accident caused. What you are entitled to financial support will depend on your accident details and the nature of your injuries.

The compensation for personal injuries claims often provides coverage for:

  • Suffering and pain
  • Medical bills for the past and future
  • Medical devices and medication
  • Rehabilitation services
  • Mental anguish
  • Temporary or permanent disability
  • Property damage
  • Loss of wages
  • Incapacity to continue working
  • Punitive damages

A fatal accident could result in the death of a family member. You should speak with an attorney if you lose someone you love in an accident.

This type will allow you to seek additional compensation appropriate for your tragic loss. These damages may be covered by wrongful death lawsuits:

  • End-of life medical care
  • Funeral services, burial, and cremation
  • Loss of consortium
  • Loss of future income
  • Loss of benefits

An attorney is necessary to fully comprehend the financial implications of an accident. They can help you determine the value of your settlement and will not let you accept less than what you are entitled to.

Your lawyer will negotiate for fair compensation on your behalf and be available to represent you in court if needed.

The IRC’s “Auto Injuries: Claiming Behavior and Its Impact on Insurance Costs” report also found that 85% of all money paid out for bodily injury claims goes to clients who have legal representation. According to CMPD, the Nissan was directly in front Hyundai, causing the collision.

Officers state that speed and impairment are not contributing factors to the Hyundai driver’s crash. The driver was wearing a seatbelt at time of collision.

Freedom Drive was closed between Alleghany Street & Camp Greene Street during the investigation. Shortly after noon, the road was reopened.

To avoid the incident, drivers in the vicinity can use Tuckaseegee Road. Drivers headed towards Uptown can use Ashley Road and Wilkinson Boulevard to enter the city.

10 Important Things You Need To Know After A Car Accident

What You Need To Know After A Car Accident

Most automobile accidents lead to only damaged property, which is a good thing. However, two out of ten accidents result in someone losing their life.  One out of three accidents involves someone getting hurt.  Because of this, you need to understand what to do at the scene of an accident, should you be involved in one.

1- Stop.  It is that simple.  If you have been in an accident don’t run away.  You need to ensure that everyone is okay.  Even if it was a minor one, if it involved another person’s car or property, it is your responsibility to let the other owner know and exchange information.  Sometimes the police should be called out or if necessary call for medical assistance.  But, don’t run away from an accident.

2-Protect the Scene.  Be sure, when possible, that the flashers are on.  When it is dark, this is especially important as you want others to see you.  Either stay in your car or if you feel that your safety is in danger, you can stand outside of the car.  Be on the alert, so you don’t cause another accident.

3-Call the Police.  Call the police to get a police report. This is often necessary if you are going to be filing a claim with your insurance company.  Typically you want to leave the vehicles where they are, but if they are interfering with traffic, pushing off to the side of the road is a better option.

4- Make an accurate record.  If you don’t know something, tell them that, don’t speculate or guess at what happened.  Sometimes we don’t know what happened as accidents can happen so fast.  If you are asked if you are injured, for example, and you don’t know, say you don’t know.  You should also make sure that statements by the other parties are accurate as well.  Many times, when injuries occur because of an accident, they appear a few hours later.

5-Take pictures.  While this might not be the first thing on your mind, taking pictures will show how the vehicles are on the road for anyone questioning things later.  Get pictures from all sides that will accurately help those investigating see what happened.  You have probably heard the words, a picture is worth 1000 words.

6-Exchange Information. Usually, the responding officer will gather up all this information.  However, if there isn’t a responding officer, you will need the names and numbers of all those involved.  You should exchange insurance information, usually, a picture with your phone will work for this task.  If there were any witnesses, be sure that you get their information as well, in case you need them later.

Usually, the responding officer will provide those that are in an accident with a police report number and a card that will have their information on it.  Be sure you put that in a safe spot for later.  That number will correspond with the police report they will write up later, usually in a day or so you can get a copy of that.  If the accident happened on a State highway, you will need to contact the state police.  Again, most of the time, they give you a card with all the information on it that you will need.

7-Report that accident to your insurance company.  This is an important step as most insurance companies require you to report right away.  Most of the time you have what they call medpay on your insurance, as a part of the policy.  This means that they will cover any of your medical bills.  Medpay insurance covers the medical bills of the occupants of the car as well. You should use this, as it is what you pay them for. Once this benefit is exhausted then your normal medical insurance becomes primary again.

8-Seek Medical Attention.  Many times at the scene you don’t feel much pain.  The rush of adrenalin has covered up the pain. However, as the day goes on or even a couple of hours later, you might start to feel pain.  Even if you don’t think it is something serious, you should always be checked out.  Even small minor fender benders can cause serious issues with the spinal cord.  You could have gotten a concussion, even a small one is considered a closed head injury and you should be looked at by a physician.

9-Keep a file.  Keep everything in one spot from the police report to any medical bills that come in.  You will have several contacts including your claims adjuster and even someone from the other parties’ insurance company from time to time.  Keep track of all of this information to ensure that you have everything properly documented.

10-Consult an Attorney.  Many times insurance companies will follow up with you right away to get your statements. This can be detrimental in your case, especially if your injuries don’t show up until a few days later.  Be sure that you consult your attorney to know your rights and know what to actually say to get the most out of the insurance company.

Most personal injury attorneys work on a contingent basis, meaning they won’t take your case if they don’t think they will win.  They don’t get paid until they win, so speaking to them after an accident is very affordable, in most cases it is totally free.  So, why wouldn’t you consult an attorney to be sure that you are getting what you deserve from being in an accident?  Your property has been damaged, even if there aren’t any injuries.

Personal Injury Cases Take Time To Settle – 6 Reasons

Personal Injury cases can take time to settle

A personal injury case trial is no fun, and settlement can often be as difficult – if not more so – than a trial.

The frustration people feel while in the midst of settlement negotiations largely stems from a lack of awareness about the process: How it works, what is going on, and why things are taking so darn long.

Luckily for you, we have some answers for you as to why it can take time to settle your personal injury case.

Here are six major reasons that your settlement negotiations are taking more time than you thought they would:

  1. Time Limits

There is a statute of limitations on every personal injury case and this is why it is so critical that you file as soon as possible.

To avoid coming under pressure from these time limits, lawyers will often work to move things along on your behalf.

This doesn’t mean that the other side is as eager to get things going.

  1. Liability

Determining liability is another major issue in settlement negotiations.

This is a legal question and not a determination of the merits of your case in terms of what did or did not happen.

Here, your lawyer and lawyers from the other side will determine what liability exists for the other side which leads into the next discussion.

  1. Damages

Once the scope of liability is determined, your lawyer will then begin negotiating for damages to you.

Of course, the counterparty will negotiate on behalf of their clients just as vigorously if not more so.

If settlement looks like the direction the case is going, don’t expect the other side to be immediately generous.

One of the items that will be negotiated is lost wages as a result of the accident.

The other will be diminutive value as a result of the loss in value to your vehicle.

This is something most insurance carriers will not tell you about and the reason you need an experienced car accident lawyer.

  1. Evidence Collection

If things are still in the settlement negotiation stages, evidence collection is probably going on at the same time.

This includes documentation, reports – whatever might be necessary to make your case.

Often times, collecting medical documents takes longer than most expect.

The same will hold true for collecting police reports and any accident reconstruction documents that may be available.

  1. Expert Witnesses

If it looks like things will go to court, your lawyer will have to begin the process of finding expert witnesses to corroborate the basics of your case.

This could include doctors, workplace safety officials, or any other person that can shed some light on the specifics of your case.

This stage can be deceptively complicated because newer lawyers won’t have quite the network to draw upon that older, established lawyers will.

Stay in discussion with your lawyer about the status of your case as well as any experts he thinks might be needed should the case go to trial.

  1. Alternative Dispute Resolution

Known by many names, such as mediation, alternative dispute resolution seeks to bring disputant parties together to come to some sort of agreement outside of the courthouse.

ADR is a process that seeks to avoid the sometimes lengthy courtroom battles that can occur between parties and is an unbiased, non-binding process.

Some courts will even require people to go through an ADR process first before heading to trial.

Conclusion

As you can see there is a lot involved in the entire legal process, and it’s best to have an experienced attorney on your side to help you get the best result possible for your case.

8 Key Steps To A Successful Personal Injury Case Checklist

What Are The Key Steps To A Successful Personal Injury Case?

Personal injury cases can be tricky to navigate. In a sense, the clock is ticking as soon as the accident occurs and any move you make could potentially cost you the case. We have prepared a personal injury case checklist. If you get injured, you’ll likely need financial help to deal with medical bills, money lost from not working, etc.

So here is our personal injury case checklist, all 8 key steps you need to take for a successful personal injury case.

Personal Injury Case Checklist

  1. Don’t Accept the Blame

If you’ve ever seen a cop show you know that when someone is arrested, they are told that anything they say may be used against them in a court of law. This also applies to accidents. If you tell the person that the accident was your fault, this could be all they need to stop your personal injury claim case in court. Even saying something innocent like you’re sorry may be taken as an admission that it was your fault.

Make sure to pay close attention to what everyone is saying and be sure to give nothing but absolute facts instead of opinions.

  1. Call the Authorities

All accidents should be reported to the proper authorities. Reporting establishes a paper trail that could be used in court if needed. You should also get any injuries documented and checked as early as possible. These medical records and medical bills will be important to your personal injury claim.

If you experience pain following an accident, let the police know so that they can document it and have it checked out.

  1. Document Everything

Speaking of documenting, make sure that you properly document everything that happens in an accident. The responding police officers should make documents, but it helps to have your own on hand. Make sure to take pictures of the property damage, including personal damage, with your phone.

Get the names and contact information of potential witnesses too who were at the accident scene. Those at the accident scene can provide valuable documentation and compliment the police report.

  1. Have a Doctor Look You Over

It’s possible the injury might not manifest for a few days. Make sure you go to your doctor and get checked out when you can. This ensures you get the medical attention you need while also adding to the paper trial for court proceedings. These medical records and medical bills help in personal injury cases establishing pain and suffering.

  1. Listen to Your Doctor

Many people have destroyed their own cases by not following their doctor’s orders. If a doctor tells you to get plenty of bed rest for a week and you’re working again in a few days, then you do more than compromise your recovery. You are also giving a defense attorney ammunition to use against you. They can claim that you exaggerated your injuries. Always listen to your doctor and do what they say. The doctors instructions will always be contained in your personal medical records.

  1. Lawyer Up

Lawyers, much like doctors, have their own specialties. You shouldn’t hire a tax attorney for your divorce, and you shouldn’t hire a corporate attorney for a personal injury case. Find a personal injury lawyer. If possible, find one who has experience in your kind of injury, such as a lawyer with a history of malpractice cases.

  1. Don’t Sign Anything

If you were to sign a settlement offer or a statement admitting you were at fault, then you aren’t going to get the compensation you deserve. Make sure a personal injury attorney looks through settlement offers before you sign them.

  1. Don’t Talk to Insurance Companies Without Consultation

Keep in mind that you might be fighting the insurance company themselves, as well as the people they represent. You should have an attorney who can act as a go-between for all parties.

If you are injured due to the negligence of someone else, then you are deserving of all potential compensation. The only way you can do that is to handle the situation properly though. Keep

this personal injury case checklist handy and follow these eight steps in mind the next time you are involved in an accident.

How to Find the Right Personal Injury Lawyer

Things happen in life, and when they do, it is best to have competent, professional legal representation on your side. Here is our guide to find the right personal injury lawyer for you in Charlotte NC.

That is why it is absolutely necessary that you find the right personal injury lawyer for your case. Not only will this make things go more smoothly if the case goes to court, but also your lawyer will know how to assess your injury and what can be done about it.

But not everyone knows what to look for in a lawyer, or even how to find one to begin with. So to help you navigate the often complex process of finding legal representation, here are five tips for finding the right personal injury lawyer for you:

Have Some Idea of What You Want from the Process

Before you begin looking for a lawyer, figure out what you want to get out of this process. This doesn’t just mean compensation but also think about things like how willing you are to go to trial or how ready you might be to settle.

On top of that, decide whether or not an aggressive form of representation or a more congenial approach is what you want in a lawyer. Every attorney has their own style, and not every client fits with every attorney.

You also need to find lawyers that specialize in your particular case. Don’t just go for a generalist – you want someone who specializes in what happened to you. Knowing what you want as a client will help you navigate this critical early stage in the process of finding a personal injury lawyer.

Knowing Where to Look

The Internet is one of your best resources for finding a good lawyer. Beyond just a simple Google search, however, the Internet provides a wealth of resources when it comes to previous client reviews and even professional accreditation.

Scour the Internet and professional legal associations to find the best lawyer in your case area where you live.

Discuss Fees Ahead of Time

When meeting with potential lawyers, you will want to discuss how they work and like to get paid. Many accident lawyers work on a contingency fee basis. What this means is that they don’t get paid if you don’t get paid.

But not every lawyer is like this which is why you need to have a conversation with your prospective attorney ahead of time.

Meet Your Lawyer

The initial meeting is really important. That’s why the preliminary first step helps you situate your case (and yourself) in the context of what you want a lawyer to do for you. Meet with your lawyer in person and take advantage of free consultations.

Just like with a doctor, you will want to go to more than one so be prepared to interview a couple of lawyers before you settle on one.

You Can Always Hire a New Lawyer

If it doesn’t work out with your current lawyer, do what is best for you and begin the process of looking for a new lawyer. Whether your current lawyer isn’t a good fit, is dragging his feet, or whatever other complaint you have, just know you can find someone else if you need to do that.

These are five important tips you should consider to find the right personal injury lawyer for your case.
